(we, us or our), makes no representations, warranties or guarantees as to the accuracy, completeness, appropriateness and suitability of any and all advice, assistance, information or deliverables (collectively, the Materials) provided by us, whether in a tangible format or not, to the person or entity receiving the Materials (you or your).

 

While we use reasonable attempts to ensure that the Materials are accurate and complete, the Materials are general information only, are not comprehensive and is not specific to your circumstances. Unless otherwise agreed between you and us, our provision of any Materials does not grant you ownership of the intellectual property rights in the Materials.

 

Nothing in this document excludes your statutory rights under the Australian Consumer Law in the Competition and Consumer Act 2010 (Cth). Despite any provision to the contrary, to the maximum extent permitted by law, by using the Materials:

a)    you warrant that you have not relied upon any warranty, representation, statement, offer or documentation made or provided by or on behalf of us;

b)    you agree that we exclude all terms, conditions and warranties implied by statute, in fact, or on any other basis, except to the extent such terms, conditions and warranties are expressly agreed between you and us in writing;

c)    we will not be liable for any consequential loss, indirect loss, real or anticipated loss of profit, loss of benefit, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings, loss of reputation, loss of use and/or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity or otherwise; and

 

d)    we will note be liable for, and you forever discharge and voluntarily release us (and our contractors, agents and employees) and any person directly or indirectly associated with us, against any and all loss, cost, damage, expense, liability (including liability for negligence and the negligence of others) claims, demands and proceedings of any kind arising from or connected with the Materials and your use of the Materials, whether those claims were known, or capable of being known, before use.
